Capital GainsTax Tip #285: Understanding Unrecaptured Section 1250 Gain
When selling rental property, depreciation recapture is taxed at a maximum 25% rate as "unrecaptured Section 1250 gain." This applies to all straight-line depreciation claimed. If you depreciated $100K over your holding period and are in the 24% bracket, your recapture rate is 24%. But if you are in the 32% bracket, it is capped at 25%, saving you 7% on that $100K.
