Tax Tip #245: Like-Kind Exchange Rules for Mixed-Use Property

If you use a property partly for personal use and partly as a rental, only the rental portion qualifies for 1031 exchange treatment. A duplex where you live in one unit and rent the other requires you to split the sale: 50% qualifies for 1031 deferral and 50% may qualify for the Section 121 primary residence exclusion.
