Tax Tip #223: Constructive Receipt and Security Deposits

Security deposits are not taxable income when received if you plan to return them. They become income only when you keep all or part of the deposit for damages or unpaid rent. If you apply a security deposit as last months rent at lease signing, it is taxable income immediately. Track each deposit separately with tenant name and amount.
